Flutistry Boston offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Returns & exchanges
Several types of items are exempt from being returned, including new or preowned instruments (flutes, piccolos, altos, basses, headjoints, footjoints, crowns, etc), sheet music, special orders, gift cards, clearance items and downloadable media. To be eligible for a return or exchange, your item(s) must be unused and in the same condition that you received it, including the original packaging. If a return or exchange is accepted, a 10% restocking fee may apply.
For qualified items purchased in person, by phone, or via the web, requests for return must be made within 10 calendar days of purchase/invoice date and are subject to approval. Once approved, a return authorization (RA) number, valid for 10 calendar days from issuance, will be provided . If either the return request or return authorization time frames have expired, we cannot offer you a refund or exchange. To complete your return, we require an original receipt or invoice.
Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item and to notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit (minus any restocking fees and shipping costs) will automatically be applied to your credit card or original method of payment. All shipping costs are non-refundable.
If you haven’t received your refund within 10 business days of approval, first double check with your bank and/or credit card company as it may take some time before your refund is officially posted. If you’ve done all of this and you still have not received your refund yet, please contact us.
Exchanges (if applicable)
We only replace items if they are defective or damaged when received. If you need to exchange it for the same item please contact us then send your item to us for inspection at Flutistry Boston 801A Tremont St, Boston MA, USA 02118.
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive Flutistry Boston store credit for the value of your return once it is received.
To return your item(s) you should mail your product, with RA number clearly marked on the package, to Flutistry Boston, 801A Tremont St Boston MA USA 02118. Please do not send your purchase back to the manufacturer. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you may vary. If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item. If we make an error in the fulfillment of your order please contact us at your earliest convenience so we can correct it.
If you find that any of the merchandise you have purchased is defective, please contact Flutistry Boston within 10 calendar days of the purchase. Beyond 10 calendar days, the customer will need to contact the product manufacturer.
To ensure prompt and secure delivery, we ship all orders over $100 with a signature required upon delivery. Any orders below $100 will not require a delivery signature. To waive the signature requirement, and our liability, please notify us using the Customer Notes section when placing your order online.
FREE SHIPPING ON INSTRUMENT PURCHASES OVER $1000
Any online purchase for instruments priced over $1000 will qualify for free shipping within the US. The shipping method will be the choice of Flutistry Boston. Additional shipping charges may incur if non-instrument products are part of the same order as the qualifying instrument purchase.
OTHER FREE OR DISCOUNTED SHIPPING OFFERS
If free or discounted shipping is offered by Flutistry Boston, it is the choice of Flutistry Boston to select the shipping carrier and method.
DAMAGES FROM SHIPPING
Flutistry Boston will not knowingly send any damaged products when fulfilling product orders. If the shipment was damaged during transit, it is the customer’s responsibility to notify the shipping company immediately upon receiving the item and to submit a claim.
Sales tax is charged only on orders shipped to locations within the state of Massachusetts. Massachusetts state laws require that we charge sales tax on the full amount of the order (not including any charges for services). We charge sales tax on orders in accordance with all governmental tax codes/law. Sales tax will be automatically calculated according to these laws by our website during the checkout process.
MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
If you have ordered an item that is not available to ship within 2 business days of placing your order, we will attempt to contact the customer using the information provided with the online order to determine how to proceed with said order. The customer will then have the option to choose either a Partial Fulfillment (multiple shipments) of the order or Compete Fulfillment (single shipment). With a Partial fulfillment, we will ship you items as they become available and you will be responsible for any additional shipping costs. With a Complete fulfillment, the entire order will be shipped as one package once all products ordered have become available. The length of time to receive a product that is on backorder can vary. We will work to get these backordered items in a reasonable amount of time but please keep us informed of any time limitations you may have regarding any backorders.
Special Orders and Requests
If you would like to order an item that is not regularly stocked or advertised by Flutistry Boston, we are happy to do so at no extra charge. Any requested items must be available from the regular suppliers of Flutistry Boston. Special orderes will be deemed non-returnable and payment will be required when the order is placed. If you would like us to stock a large quantity of items for your students, schools, organizations or other events, please contact us so we may work with you to make these products available.
